This Policy should be read in conjunction with our Terms of Use, into which this Policy is incorporated by reference.
This Policy describes:
The types of information we collect from you or that you may provide when you access or use our website application available at: https://shvo.ility.tech/ (the “Web Application”), as well as our mobile application (the “Mobile Application”, together with the Web Application, the “Platform”).
Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Policy applies to information we collect on the Platform or in emails and other electronic messages between you and the Platform. This Policy applies to your use as a user of the Platform, including as an employee or contractor of our Tenants (as defined below).
This Policy does not apply to information collected by us offline or through any other means, including on any other website operated by any third party, or information collected by any third party through any application or content that may link to or be accessible from the Platform (for further information, see below, “Third-party Websites”).
Please read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices, then please do not use the Platform. By using the Platform, you agree to the terms of this Policy. This Policy may change from time to time (see below, “Changes to this Policy”). Your continued use of Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
Tenant Agreements. Use of the Platform and any user information associated with the Platform may also be subject to the terms of separate written agreements (the “Tenant Agreements”) between the Company and its contracted tenants (“Tenants”). When applicable, this Policy may be superseded by specific terms in the Tenant Agreements. If you use or submit any materials on the Platform as an employee or contractor of a Tenant, you agree to be bound by the Tenant Agreements as well as any posted guidelines and policies related to the materials you wish to use or submit, as applicable. When applicable, Your use of Platform is deemed to be acceptance of the terms of the Tenant Agreements.
What Information Does the Platform Collect?
To ensure that we provide you with the best possible experience, we will store, use, and share information about you in accordance with this Policy.
Information You Provide to Us
Personal Information is any information that can be used to individually identify you from a larger group, such as data including, but not limited to, your:
first and last name;
email address;
telephone number;
mailing address;
company name;
vehicle information (make, model, color, license plate number)
credit card or payment information (i.e. PayPal); and
comments or messages provided in free text boxes.
You may provide us Personal Information when you:
request information;
submit a maintenance request or work order;
claim any available perks;
participate in a questionnaire or survey;
subscribe to our emails;
purchase products or services; and
register yourself with the Platform
seek access to a building.
The information that you provide in each case will vary. In some cases, you may be able to provide Personal Information via email or free text boxes, such as contacting the Company to request further information. When providing your Personal Information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers, credit card information or other sensitive personal data when it is not needed. Additionally, we may ask you to create a username and password that should only be known to you.
Building Access
Access to certain parts of Company’s building may require an authorization, where the Platform serves as a tool for identifying you and verifying your access rights.
Your approximate GPS location received from your mobile device may be processed in order to enable the scanning function of the Platform on the device that allows you to pass through building turnstiles or similar access points of certain buildings owned by Company, and to enhance the reliability of the mobile access function in the background of the Platform.
Your turnstile entry data may be processed to schedule delivery of relevant system messages to your device when you enter Company’s buildings.
Reservations
If you use or engage with any product or service offered through the Platform, your company name, e-mail address, first and last name are disclosed to us.
Maintenance Requests
The maintenance request function enables reporting of malfunctions of equipment or similar issues in the building to the Company and the related property manager, who will receive the reporting user’s e-mail address, first and last name and malfunction report for the purposes of further resolution of the report. We may share this personal information with third parties taking part in the maintenance of the building to resolve the submitted requests.
Automated Information Collection
In addition to the information that you provide on the Platform, the Company and the Platform Provider (defined below) may also collect information about you during your visit to the Platform. The Company and the Platform Provider collect this information using automated tools that are detailed below. These tools may collect information about your behavior and your computer system, such as your internet address (IP Address), the pages you have viewed, and the actions you have taken while using the Platform. Some of the tools used to automatically collect information about you may include:
Cookies. A “cookie” is a small data file transmitted from a website to your device’s hard drive. Cookies are usually defined in one of two ways, and we may use either (or both) of them:
(1) session cookies, which do not stay on your device after you close your browser, and
(2) persistent cookies, which remain on your device until you delete them or they expire.
The Company and the Platform Provider may use the following categories of cookies on the Platform.
Strictly Necessary Cookies. These cookies are essential in order to enable you to move around the Platform and use its features. Without these cookies, services you have requested, such as maintaining a record of your purchased items (e.g. a shopping cart), cannot be provided.
Performance Cookies. These cookies collect anonymous information on how you use the Platform to help us understand how you arrive at the Platform, browse or use the Platform and highlight areas where we can improve, such as navigation. The data stored by these cookies never shows personal details from which your individual identity can be established.
Functionality Cookies. These cookies remember choices you make such as the country from which you visit the Platform, your preferred language, and your search parameters. This information can then be used to provide you with an experience more appropriate to your selections and to make your visits to the Platform more tailored to your preferences. The information in these cookies may be anonymized. These cookies cannot track your browsing activity on other websites.
Of course, if you do not wish to have cookies on your devices, you may turn them off at any time by modifying your internet browser’s settings. However, by disabling cookies on your device, you may be prohibited from full use of the Platform’s features or lose access to some functionality.
Your Choices and Selecting Your Privacy Preferences
We want to provide you with relevant information that you have requested.
We will not send you email newsletters and marketing emails unless you consent to receive such marketing information. After you request to receive these emails, you may opt out of them at any time by selecting the “unsubscribe” link at the bottom of each email. Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which email communication is a requirement of the service provided.
Accuracy and Access to Your Personal Information
We strive to maintain and process your information accurately. We have processes in place to maintain all of our information in accordance with relevant data governance frameworks and legal requirements. We employ technologies designed to help us maintain information accuracy on input and processing.
Where we can provide you access to your Personal Information in our possession, we will always ask you for a username and password to help protect your privacy and security. We recommend that you keep your password safe, that you change it periodically, and that you do not disclose it to any other person or allow any other person to use it.
To view and change the Personal Information that you have provided to us, you can log in to your account and follow the instructions on that webpage, or contact us directly for assistance.
Information of Minors
We do not intentionally seek to gather information from individuals under the age of eighteen (18). We do not target the Platform to minors, and would not expect them to be engaging with the Platform or services. We encourage parents and guardians to provide adequate protection measures to prevent minors from providing information unwillingly on the internet. If we are aware of any Personal Information that we have collected about minors, we will take steps to securely remove it from our systems.
How We Use Your Information
The information we gather and that you provide is collected to provide you information and the services you request, in addition to various other purposes, including, but not limited to:
Accessing buildings within the Transamerica Pyramid block and amenities provided by Landlord and its approved vendors.
Facilitate account creation and the logon process.
Assisting you with items such as personalized experiences, facilitation of product usage, and enforcement of the Terms of Use.
Preventing malicious activity and providing you with a secure experience.
Providing service and support for services you request.
Providing marketing communications that are effective and optimized for you.
Keeping you up-to-date with the latest benefits available from us.
Preventing unwanted messages or content.
Contacting you about services and offers that are relevant to you.
How We Share Your Information
We do not sell or share your Personal Information with any third party for cross-context behavioral advertising purposes. We may disclose your Personal Information to our trusted third-party business partners in accordance with this Policy. We work with a number of partners that help us process your requests, deliver customer service and support, send email marketing communications, and provide experiences that you have come to expect from us. We will share your Personal Information with these third parties in order to fulfill the service that they provide to us. These third-party partners are under contract to keep your Personal Information secure and not to use it for any reason other than to fulfill the service we have requested from them.
Platform Provider. The software and technology used to operate the Platform is provided by Ility.com, Inc. (the “Platform Provider”). While the Platform Provider provides the software and technology to process the information and materials on the Platform, the Platform Provider does not collect, use or otherwise store your Personal Information, unless necessary to provide its services for the Platform. However, the Platform Provider may aggregate or otherwise anonymize any data collected on the Platform for purposes of analytics, research, marketing and other business interests of the Platform Provider. Such use by the Platform Provider shall not include Personal Information or information that can identify you as an individual or reasonably be used to identify you. Additionally, Company does not share, sell, distribute or otherwise transfer your Personal Information to the Platform Provider unless it is necessary to perform its services for the Platform.
Exceptions. We may share your information with third parties without notice and your consent in the following circumstances:
Responding to duly authorized information requests from law enforcement or other governmental authorities.
Complying with any law, regulations, subpoena, or court order.
Investigating and helping prevent security threats, fraud, or other malicious activity.
Enforcing or protecting the rights and properties of Company or its subsidiaries.
Protecting the rights or personal safety of Company’s employees.
As otherwise permitted under applicable data privacy law.
There are circumstances where the Company may decide to buy, sell, or reorganize its business in selected countries. Under these circumstances, it may be necessary to share or receive Personal Information with prospective or actual partners or affiliates. In such circumstances, the Company will ensure your information is used in accordance with this Policy and applicable law.
Third-party Websites
This Policy does not apply to websites or other domains that are maintained or operated by third parties or our affiliates. The Platform may link to third-party websites]and services, but these links are not endorsements of these sites, and this Policy does not extend to them. Because this Policy is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or site and providing any information.
Location of Company’s Services
Company’s corporate headquarters is based in the State of New York within the United States. We do not warrant or represent that this Policy or the Platform’s use of your Personal Information complies with the laws of every jurisdiction. Furthermore, to provide you with our services, we may store, process, and transmit information in the United States and other locations around the world, including countries that may not have the same privacy and security laws as yours. Regardless of the country in which such information is stored, we will process your Personal Information in accordance with this Policy.
Changes to this Policy
If we make any changes to this Policy, a revised Policy will be posted on this [webpage] or screen and the date of the change will be reported in the “Last Revised” block above.
Safeguarding the Information We Collect
We use reasonable technical, administrative, and physical safeguards in order to protect your Personal Information against accidental loss and from unauthorized access, use, alteration, and disclosure. “Sensitive” personal information as defined in the CCPA is personal information that reveals: (a) your social security, driver’s license, state identification card, or passport number; (b) your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) your precise geolocation; (d) your racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of your mail, email, and text messages unless we are the intended recipient of the communication; and (f) your genetic data. “Sensitive” personal information also includes biometric information that is processed for the purpose of identifying you, information that is collected and analyzed concerning your health; or your sex life or sexual orientation.
You have the right to know the categories of “sensitive” personal information we have collected about you, the categories of sources from which we collect personal information, our business or commercial purpose for collecting, selling or sharing “sensitive” personal information, the categories of third parties with whom we sell or share “sensitive” personal information, if any, and the specific pieces of “sensitive” personal information we have collected about you.
Right to Delete Your Personal Information
Subject to the exceptions set out below, and upon your submission of a verifiable request, you have the right to deletion of your personal information from our records, and to have us direct our service providers, contractors and third parties to delete your personal information from their records.
We are not required to, and reserve our right to not delete your personal information if it is necessary to: (i) complete the transaction for which the personal information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; (ii) help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for those purposes; (iii) debug to identify and repair errors that impair existing intended functionality; (iv) exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; (v) comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code; (vi) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; (vii) enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us and compatible with the context in which you provided the information; and (viii) comply with a legal obligation.
Right to Correct Inaccurate Personal Information.
Subject to the exceptions set out below, and upon your submission of a verifiable request, you have the right to correct any inaccurate personal information in our records, and to have us direct our service providers, contractors and third parties to correct any inaccurate personal information from their records.
If we cannot verify your identity pursuant to the CCPA and its regulations we may deny a request to correct. In such event, we shall inform your that your identity cannot be verified.
In determining the accuracy of the personal information that is the subject of your request to correct, we shall consider the totality of the circumstances relating to the contested personal information. We may deny your request to correct if we determine that the contested personal information is more likely than not accurate based on the totality of the circumstances.
Right to Be Free from Discrimination
You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, on the basis of the exercise of your rights thereunder, among other things, deny goods or services to you, charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; provide a different level or quality of goods or services to you; or suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services or retaliate against you as an employee, applicant for employment or independent contractor.
Right to Opt-Out of the Sharing of Personal Information
We do not disclose your personal information to third parties for cross-context behavioral advertising purposes (“Share” or “Sharing”), which means the targeting of advertising to you based on your personal information that we obtain from your activity across businesses, distinctly-branded websites, applications, or services, other than our business, distinctly-branded website, application, or service.
Since we do not “Share” your personal information, we do not provide a “Do Not Sell or Share My Personal Information” opt-out link.
Right to Opt-Out of the Sale of Personal Information
We do not disclose your personal information to third parties in exchange for monetary or other consideration. Such disclosures are considered to be “Sales” under the CCPA. Since we do not “Sell” your personal information we do not provide a “Do Not Sell or Share My Personal Information” opt-out link.
Right to Opt-Out by Using Opt-Out Preference Signals.
Since we do not Sell or Share your personal information, we do not recognize and process any Opt-out Preference Signal which is a signal that (a) is in a format commonly used and recognized by businesses (for example, in an HTTP header field) and (b) is sent from a platform, technology, or mechanism that makes it clear to the consumer, whether in its configuration or in disclosures to the public, that the use of the signal is meant to have the effect of opting the consumer out of the sale and sharing of their personal information.
Right to Limit the Use of “Sensitive” Personal Information
We use your “sensitive” personal information only to the extent that it is necessary to provide our goods and perform our services as reasonably expected by you. Since we do not use your “sensitive” personal information for any purpose other than is necessary to provide our goods and service, we do not provide a “Limit the Use of ‘Sensitive” Personal Information” opt-out link.
Right of Children to Opt-In to the Sale of Personal Information
We do not knowingly collect the personal information of minors under the age of 16 and we do not sell the personal information of any user. Accordingly, we do not provide a procedure for minors to opt-in to the sale of personal information.
HOW TO EXERCISE YOUR CCPA RIGHTS
Unless otherwise specified, to exercise any of your rights described in this Appendix A, please submit your request to us at (212) 380-2100 or at shvoapp@shvo.com with the subject “CCPA Consumer Request.”
In order to verify your request, we will need you to provide us with enough information to identify you (e.g., your full name, address, and customer or matter reference number), proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill), and a description of what right you wish to exercise along with any information to which your requests relates. If feasible, we will match the identifying information provided by you with the personal information that we already maintain about you.
You may designate an authorized agent to make a request under the CCPA on your behalf. In order to fulfill your request to know or delete submitted by an authorized agent, you must provide the authorized agent written permission to do so, and we may require that you verify your own identity with us directly.
We reserve our right not to grant a consumer request if we cannot verify that the person making the request is the person about whom we have collected information, or someone authorized to act on such person’s behalf. You may only make a request to access or receive copies of personal information twice within a 12-month period. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

Affiliates
We may disclose your personal information to our parent company and entities under shared corporate control (“Affiliates”).
Contractors
We disclose personal information to entities that help us fulfill a business or commercial purpose including, but not limited to, shipping companies that deliver our products to you (“Contractors”). Contractors are not permitted to sell or share your personal information or to use your personal information other than to perform the tasks we assign to them.
Service Providers
We disclose your personal information to companies that process personal information on our behalf for a business or commercial purpose, including, but not limited to, website hosting, app design, database management, web analytics, app analytics, billing, payment processing, and communicating with you about our products or services (“Service Providers”). Service Providers are not permitted to sell or share your personal information or to use your personal information other than to perform the tasks we assign to them.
Compliance with Laws
We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose your personal information to government or law enforcement officials or private parties in response to lawful requests when we believe disclosure or sharing is necessary to comply with any legal obligation, enforce or apply our terms and conditions, respond to claims and legal process, protect our services, members, dealers, our rights and/or the safety of the public or any person, or prevent or stop any illegal, unethical or legally actionable activity (including for the purposes of fraud protection).
Sale or Transfer of Business or Assets
We may disclose some or all of your personal information in connection with a merger, bankruptcy, or other transaction in which another entity assumes control of all or part of our business. Shine the Light Request.
Individual consumers who reside in California and have provided us with their personal information may request information about our disclosures of certain categories of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes so we do not offer or respond to “California Shine The Light” requests.
Minor’s Right to Remove Posted Content.
If you are a California resident under the age of 18, and a registered user of any website where this Policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information that you have publicly posted. To make such a request, please send an email with a detailed description of the specific content or information to [email address] with the subject “Privacy Rights for Minors.” Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
Do Not Track.
We do not track users over time and across third-party websites for targeted advertising purposes. Therefore we do not recognize and respond to “Do Not Track” signals from your internet web browser.
FOR PLATFORM VISITORS IN THE EUROPEAN UNION (“EU”):
Under the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, or “GDPR”), individuals in the EU are afforded specific rights with respect to their Personal Information, or “personal data” as defined under the GDPR. For the purposes of this Policy, the Company operates as a data controller. Any personal data we collect from you is processed in the United States and under the terms of this Policy.
Any personal data we collect from you is processed in the legitimate interest of our business and providing our services to you as the lawful means of such processing. You may always withdraw your consent to our use of your personal data as described below. We will only retain your personal data for the time necessary to provide you the information and services to which you have consented, to comply with the law and in accordance with your rights below.

Automated Processing and Decision-Making. You may email us at shvoapp@shvo.com to request that we stop using your personal data for automated processing, such as profiling. In your email, please explain how you wish us to restrict automated processing of your personal data. When such restrictions are not possible, we will advise you accordingly. Using the same email address associated with your Platform account, simply type the words “WITHDRAW CONSENT” in the subject line of your email. Upon receipt of such a withdrawal of consent, we will confirm receipt and proceed to stop processing your personal data. Erasure. If you should wish to cease use of our Platform and have your personal data deleted from our Platform, then you may submit a request by emailing us at shvoapp@shvo.com.
